Terms & Conditions of Entry, Booking & Participation
Important – Please Read Carefully
By purchasing a ticket, making a booking, or selecting “I AGREE” online, you confirm that you have read, understood and agree to these Terms & Conditions, including the Risk Warning and Liability provisions. This agreement is legally binding and takes the place of a physical signature.
If you make a booking or purchase on behalf of another person (including a child), you confirm that you do so as their authorised agent and that these Terms apply to them.
1. Definitions
- We / Us / Our means Tru Ninja Rundle Mall Pty Ltd (ABN: 84 632 792 404), trading as Tru Ninja Rundle Mall.
- Site means the Tru Ninja Rundle Mall venue.
- Activities means all ninja obstacle activities, classes, casual sessions, parties, group bookings and other recreational services offered at the Site.
- You / Customer means the person making the booking and each participant.
2. Who You Are Contracting With
- All bookings and participation at the Site are provided by Tru Ninja Rundle Mall Pty Ltd.
- If a booking is made via a Tru Ninja website or central booking platform, the booking is accepted and fulfilled by Tru Ninja Rundle Mall Pty Ltd.
- Any refunds, credits or reschedules are handled solely by Tru Ninja Rundle Mall Pty Ltd in accordance with these Terms.
3. Bookings & Acceptance
- A booking is not accepted until written confirmation is issued (including email confirmation).
- You are responsible for ensuring booking details are correct.
- These Terms incorporate our Site Rules, Safety Briefing, Waiver/Release, and Privacy Policy, as updated from time to time.
4. Age, Supervision & Eligibility
- Children under 12: Must be directly supervised at all times by a parent, legal guardian or responsible adult who remains on site.
- Supervision ratio: One adult may supervise a maximum of 10 children under 12 unless otherwise directed by staff.
- Special needs participants: Must be accompanied and supervised by an appropriate carer at all times.
- Tru Ninja staff do not provide individual supervision.
5. Health & Medical Requirements
- Activities are physically demanding and involve significant risk.
- You must be in good health and free from conditions that could make participation unsafe.
- Participation is prohibited if you are pregnant, have a heart condition, a condition causing fainting/blackouts, or are wearing a cast or medical device that could increase risk.
- If unsure, you must seek medical advice before participating.
- By entering the Site, you warrant that you (and any participant you book for) meet these requirements.
6. Safety Rules & Equipment
- All participants must follow all safety briefings, signage, Site Rules and staff instructions at all times.
- Grip socks are compulsory and must be worn at all times on the inflatable attraction.
- Grip gloves are strongly recommended for use on ninja obstacle courses to improve safety and grip but are not mandatory unless otherwise directed by staff.
- Suitable footwear is required in ninja areas (trainers or grip socks). No bare feet, non-grip socks, thongs, heels or unsuitable footwear.
- Long hair must be tied back. No jewellery, belts or sharp items.
- Weight limit: Unless otherwise specified for a particular obstacle, the maximum participant weight is 130kg fully clothed.
- Participants must only attempt obstacles that are appropriate to their physical ability and skill level.
7. Behaviour, Refusal & Removal
- We may refuse entry or remove any person for safety reasons, rule breaches, reckless behaviour or suspected intoxication (alcohol or drugs).
- The decision of the manager on duty is final.
- No refund or credit is payable if a participant is refused entry or removed for breach of these Terms or Site Rules (subject to Australian Consumer Law).
8. Emergency Medical Authorisation
You authorise us to take any steps we reasonably consider necessary to protect the welfare of any participant in the event of injury or medical emergency, including administering first aid and arranging ambulance or hospital treatment. You agree to pay any third-party costs incurred (including ambulance or hospital fees).
9. Photos & Video
- You consent to images or video being captured at the Site for safety, security, operational and promotional purposes.
- If you do not consent to promotional use, you must notify staff before participation.
10. Pricing & Payment
- All prices are in Australian dollars and include GST unless stated otherwise.
- Payment must be made in full at the time of booking unless agreed in writing.
- Prices may change at any time but will not affect confirmed bookings already paid in full.
- If a pricing or system error occurs, we may cancel the booking and issue a full refund.
11. Cancellations, Changes & Refunds
A. Casual Sessions (non-party)
- No refund applies only Changes or reschedules may be permitted if requested at least 2 hours before the booked start time.
- No refunds or credits apply for late cancellations or no-shows.
- No change-of-mind refunds apply, subject to Australian Consumer Law.
B. Parties & Group Bookings (10+ participants or party packages)
- Deposits (if applicable) are non-refundable.
- One reschedule may be permitted if requested more than 30 days before the booking date (subject to availability).
- Cancellations or changes within 14 days of the booking date are not permitted and no refund or credit applies.
- Minimum numbers and package pricing apply once final numbers are confirmed.
C. Gift Vouchers
Gift vouchers are non-refundable. Rescheduling is subject to availability and these Terms.
12. Arrival & Late Attendance
- You must arrive and check in at least 15 minutes prior to your session time unless otherwise advised.
- Late arrivals may lose activity time or be refused participation with no refund.
13. Personal Property & Parking
- Personal belongings are brought onto the Site at your own risk.
- We are not responsible for loss, theft or damage to personal property to the extent permitted by law.
- Parking is used at your own risk and subject to third-party conditions.
14. Risk Warning & Liability (South Australia)
- Risk Warning: The Activities are recreational services involving significant risk of injury,including serious injury, permanent disability or death.
- You voluntarily participate and assume all inherent risks.
- Australian Consumer Law: Nothing in these Terms excludes or limits rights that cannot be excluded under the Australian Consumer Law.
- Recreational services: To the extent permitted by law (including South Australian legislation), our liability for personal injury arising from the supply of recreational services may be excluded or limited.
- Our total liability, where not lawfully excluded, is limited to resupplying the services or refunding the amount paid.
15. Force Majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including power failure, fire, government restrictions or building closures. Where required by law, refunds or credits will be offered.
16. General
- If any provision is invalid, the remainder remains enforceable.
- Failure to enforce a right is not a waiver.
- We may assign our rights where lawful.
17. Governing Law
These Terms are governed by the laws of South Australia, and you submit to the exclusive jurisdiction of the courts of South Australia.
